Collectively, all of the above people or businesses entering this Agreement will be referred to as the “Parties.”

Purpose of the Agreement

Services

Provider operates Cap Gun Studios as a professional photography studio and creative co-working space located at 1219 Union Avenue, Suite B, in Kansas City, Missouri’s historic West Bottoms. Provider grants Client access to an approximately 2,500 sq ft studio space that features rugged plank floors, exposed brick walls, and a large bank of 12′ high windows that span the entire north face of the building. Provider includes in all hourly studio rental bookings:

  • White paper backdrop (please indicate if you need this when booking)
  • 8’x8′ rolling black wooden background wall
  • Studio chairs, stools, ladders, potted plants, and use of lounge area for shooting or as waiting/staging area
  • 10′ work table/conference table with bench seating
  • Movable sit/stand desks
  • Clothing racks
  • 1 public restroom with utility sink for cleanup of paint or heavy makeup
  • 1 large public restroom with lighted vanity for wardrobe changes and makeup
  • Bluetooth speaker
  • Refrigerator, microwave, sink, and keurig (free coffee!) in kitchenette
  • Need your shoot/event catered? We recommend ordering from The Ship which is located just downstairs.

Cooperation

The Parties agree to maintain a open line of communication via e-mail, text, and call if any issues arise before, during, or after rental.

Rules While You’re In The Studio

Pets

Pets are allowed but must be kept out of any curtained-off areas of the studio. You will be held responsible for any damage caused by your pet with a minimum fee of $25 or the cost of repair/replacement of any damaged items — whichever amount is greater. If your pet causes injury to any person or other animal in the building, you will be held liable for any medical expenses the injured party incurs and may face legal action. Please indicate on the booking form whether you are bringing an animal so that the studio manager is aware.

Minors

Children are allowed in the studio but must be accompanied by an adult at all times. Children are not permitted to wander around unattended in the back half of the studio space where we have some private workspaces and equipment storage. Please respect our other tenants, equipment, and your child’s personal safety.

Food & Drink

Food and drink are allowed in the studio, but please avoid any foods or liquids that could potentially stain furniture. Please also make sure to clean up after yourselves. Pour any unfinished beverages down the kitchen sink before throwing cups in the trash/recycling and do not put any food down the kitchen sink.

Conduct

This is public building and we maintain a professional environment here. Client shall be solely responsible for the conduct and welfare of all persons accompanying client while at studio. Client agrees that Provider and other studio tenants may be present at all times. If the Provider observes or otherwise becomes aware of dangerous, pornographic, illegal, or negligent practices or activities, the Provider reserves the right to stop the shoot and may require Client and party to leave immediately. The authorities will be alerted to any illegal actives witnessed by Provider. In such case no refunds will be given for unused time.

Closed Sets

Cap Gun Studios is a 5,000 square foot studio space which has roughly 2,500 square feet dedicated to hourly rentals. We also have several bays at the back of the studio that are leased by a few other creatives who may be in the space at any time. There may also be a studio manager on-site to assist with questions about props, furniture, and to help change studio-provided paper rolls. While the space dedicated to hourly rentals will be wholly available to you and your party, the other tenants and studio manager may access the public restrooms and kitchenette which are adjacent and open to the shooting areas. If you require a completely closed set due to an NDA contract, please contact us prior to booking to make sure we can accommodate your request.

Cancellations

Client may cancel a booking up to 72 hours before the scheduled reservation start time for a 50% refund. No refunds will be given for bookings cancelled less than 72 hours prior to your reservation start time. Exceptions to this policy will be made on a case-by-case basis in the event of dangerous weather conditions.

Refunds

The maximum refund for any changes to any Client booking (requesting fewer hours than originally booked or cancellation) is 50% of the number of hours being removed from booking time and will only be granted if the request is made 72 hours or MORE in advance of booking start time. Under no other circumstances will any refund be granted. All refunds will be made using the payment account and method used to make the original reservation.

Parking

Limited on-street parking is available. Client may need to load in to the building first and then park down the street or in the lot behind the building. Starting in March, 2024, the Weld Wheel building across the street is being demolished, which may affect parking availability.

Accessibility

The studio is located on the second floor of the building and is only accessible via stairs. If your party includes individuals with mobility issues that would require elevator access, we will not be able to accommodate you.

Damage

Client is solely responsible for any damage to Provider’s property, furniture, or equipment that occurs during the time Client or his party occupies the Premises. Damages will be charged at full replacement or repair cost to the card on file.

Backdrops

All studio-provided paper backdrop handling must be done by a studio manager. Client agrees to treat provided paper backdrops with care. If you can hear the paper rustling you’re too close to the backdrop.​ Any damage done to seamless paper backdrops will result in a charge of $5 per foot. Do not touch or sit against the paper backdrop as your body oil will stain the paper and your weight and movement will cause tears and creases. Damage examples include: tears, stains, dirt footprints, visible creases, and water damage.

Props

The Client is allowed to use visibly displayed studio props. Unauthorized access to closed storage areas is prohibited. The Client is responsible for the proper placement of props after use. Additional props brought by the Client must be removed after the rental. If the Client uses studio fabrics or linens, they must be fold and placed back neatly. Studio must be cleaned, items put away, and put back in there original position by the end of the rental period or there will be a $25 cleaning fee charged to the card on file.

Liability

Client assume liability for injury to self and any person they invite to the booked session, Provider will not be held accountable. While reasonable efforts are made to maintain a safe environment, Cap Gun Studios shall not be held liable for any incidents or damages occurring during the Client’s occupancy. Provider is not liable for acts out of its control that affect the shoot, such as building equipment failures, power outages, the weather, acts of God, illness, or emergencies.

Merger

This document constitutes the complete agreement between BrushCo Studio and the Renter, superseding all prior and contemporaneous agreements. No modifications or alterations to this agreement shall be valid unless made in writing and signed by all parties involved. Any partial waiver of this agreement shall not constitute a waiver of the whole contract.

By proceeding with the rental, the Client acknowledges and agrees to the terms outlined in this agreement.
